General Terms and Conditions of Ray Moore

§ 1 Scope and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB, German Civil Code).

§ 2 Contracting Party, Formation of Contract, Storage of Contract Text

(1) The following provisions on contract formation apply to orders placed through our online shop at www.raymoore.de.

(hereinafter "we" or "us").

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but rather a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits an offer that is binding on them to conclude a purchase contract.

(4) The following provisions apply when an order is received in our online shop: the consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired goods

2) Confirmation by clicking the "Order" button

3) Review of the details in the shopping cart

4) Clicking the "Checkout" button

5) Login to the online shop after registration and entry of login details (email address and password)

6) Further review or correction of the data entered

7) Binding submission of the order by clicking the "order with obligation to pay" button

Before submitting the order in a binding manner, the consumer can return to the page on which the customer's details are recorded by using the "back" button of the internet browser used, after checking their details, and can correct input errors or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated email ("order confirmation"). This email constitutes acceptance of your offer.

(5) Storage of the contract text for orders placed through our online shop: we send you the order data and these General Terms and Conditions by email. You can also view the General Terms and Conditions at any time at www.raymoore.de/agb. For security reasons, your order data is no longer accessible via the internet.

§ 3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT and other price components.

Shipping is free of charge for the consumer. No additional shipping costs apply.

Exception – print-on-demand products: 

This shipping-cost exemption does not apply to products marked as "print on demand." These items are not shipped by us directly, but are sent to the consumer directly by an external fulfillment/printing service provider. Additional shipping costs of €5.00 per item apply, plus a handling fee of 3% of the respective item price. The exact amount of the shipping costs and the handling fee is shown to the consumer separately for the respective product during the ordering process, before the order is completed.

(2) The consumer has the option of paying by PayPal or credit card (Visa, Mastercard). No additional costs are charged to the consumer for using these payment methods.

§ 4 Delivery

(1) Unless otherwise clearly stated in the product description, all items offered by us are ready for immediate shipment. Delivery takes place within 6 business days at the latest. In the case of payment in advance, the delivery period begins on the day after the payment order is given to the bank handling the transfer; for all other payment methods, it begins on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next business day.

(2) The risk of accidental loss or accidental deterioration of the goods sold passes to the buyer only upon handover of the goods, even in the case of shipment sale.

(3) Print-on-demand products may take longer to deliver than the delivery period stated in paragraph (1), as these items are only produced and shipped by our fulfillment service provider after the order has been received.

§ 5 Retention of Title

We retain title to the goods until the purchase price has been paid in full.

§ 6 Right of Withdrawal for Consumers

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire fourteen days from the day on which you or a third party named by you, other than the carrier, took possession of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

§ 8 Warranty

The statutory warranty provisions apply. Consumers are accordingly entitled to a statutory warranty period of two years from delivery of the goods (§§ 437 et seq. BGB).

§ 9 Contract Language

German is the only language available for the contract.
